The H-2B visa program gives US companies the opportunity to employ international staff for on a temporary basis. The maximum length of time for which an employee can be invited under this visa is 1 year, though it can be extended for a period of up to 3 years. H-2B visa employees usually come for periods of 5 - 10 months and can be invited back in the following years.
As opposed to the J-1 visa program the H-2B visa workers can arrive during any time of the year whenever your business has a genuine temporary staffing need (i.e. not just in the summer time).
Under this program you will be expected to apply to the Department of Labor for labor certification. This application needs to be submitted not later than 2 months and not earlier than 3 months ahead of the anticipated arrival of workers. It is therefore essential to contact us in advance about your staffing needs, minimum 4 months before the anticipated arrival time of your staff.
Once this is completed, you will have to apply for a H-2B visa petition to the U.S. Citizenship and Immigration Services.
